Angelina was allegedly being concealed by her father, Samuel Montes.  A federal warrant for interference was issued for Samuel.  Almost one year after her abduction, Angelina Montes was brought to a Miami-Dade courtroom by her paternal grandparents.  Her grandmother, Zoraida Miller was arrested after Angelina was turned over.  The little girl was taken immediately for evaluation by the Department of Children and Family Services.  Samuel Montes was being held on a $250,000.00 bond and was serving a jail sentence of 6 months after not helping the DCF locate his daughter, while Miller was held on a $5,000.00 bond, which was quickly posted.

The story quickly evolved to a far more complicated situation, and a situation which not only erased the charges Miller had against her, but went a step further to grant the grandparents temporary custody of Angelina.  A DCF representative told a judge that the team had evaluated the child and found “no evidence of abuse”, “no environmental hazards” in the home, and that “the child is happy there”.  Considering everything DCF documented, the judge found it in Angelina’s best interest to remain with her grandparents until they could obtain full custody of her.

Angelina’s mother, Vanessa Churson, had custody of Angelina, however went back to Venezuela, leaving Samuel’s parents to care for Angelina.  Churson has remained uninterested in fighting to maintain her custody of her daughter, and has given no indications that she even has plans to return to the United States.  A judge ruled that there can be no resolution to custody of Angelina until her mother returns from Venezuela, and until that happens, she will remain with her father and grandparents.

Once the matter began to sort itself out, and the truth of the situation was brought forward in a courtroom and it was clear that Angelina was in no harm, Samuel Montes was released from jail and reunited with his baby girl.  Standing on the courthouse steps, holding Angelina in his arms, he says he has been looking forward to this day for the last 3 months.  Montes’ attorney stated “This was a situation where it was false accusations and it takes a while.  Justice delayed is justice denied, but we got there.”  All charges against Samuel have been dismissed.

The family has been reunited and have settled right back into their normal lives, which center around a beautiful little girl that fills their heart with joy.  Angelina is receiving the best of care, and is a vibrant child with a smile that sucks you right in to loving her.
