**** What a restricted case means. ****

A restricted case can mean any one of several things.  It can mean the children have been recovered, or the case has been solved, however it is not press ready at the time.  Classifying it as restricted gives the authorities and professionals time to evaluate the children, without any influence, to determine exactly how they were living and their current needs – do they need any medical treatment, counseling, drug rehab, etc. Also, during the evaluation time the professionals and authorities should be able to determine if any additional charges should be filed against the abductor(s) or anyone else.  A final determination of custody will be made (vast majority enforces orders made after the abduction), and the children will then be returned to their rightful home.  A restricted case can also mean that the case is being updated.  When this is the case, a new poster will be issued for the children and the case will be reclassified.  This generally happens within a day or two.  LTWH’s policy is to wait 7 days before reclassifying a case, therefore we avoid changing the status of a case if an update is all that is happening.  Lastly, a restricted case may mean that the publicity of the case has been ceased.  When this happens, the public is given very little information.

Nadia disappeared from Cary, North Carolina on February 3, 2009.  She was abducted by her non-custodial mother Larissa Melo Drummond.  A felony warrant was issued for Larissa on February 17, 2009.

According to Nadia’s father, Devon Davenport, Larissa threatened to take the baby to Brazil shortly after her birth.  Larissa had been born there.  She had custody of Nadia and they lived on the 100 block of Woodruff Court.  Davenport was given visitation, but he stated Larissa consistently ignored the visitation schedule.  Nadia was not supposed to be taken out of North Carolina without permission from the court, and Larissa was ordered to surrender the child’s passport.  She said Nadia did not have a passport.  After Nadia’s abduction it was determined that Larissa had in fact gotten a passport for Nadia shortly after she was born, and used it when she abducted her.

Both parents’ signatures are required to obtain a passport for a child, but Larissa was able to circumvent this rule because she did not list Davenport as the father on Nadia’s birth certificate.

Larissa took Nadia to Brazil after the abduction.  They arrived on February 5, and then disappeared again.  Davenport was given sole legal and physical custody of Nadia after she was taken and filed for her return to the United States under the civil treaty: The Hague Convention on the Civil Aspects of International Child Abduction.  Brazilian authorities accepted his application, but they have yet to enforce the treaty.  Nadia’s case remains open.

Devon Davenport continues to actively fight to bring his daughter home.  It is clear that he loves his baby girl, and clear that she loves him.  He is her Daddy.  He is the one that will protect from all the heartaches in life, so we need to make sure that we bring Nadia home.  If you have a moment, check out Davenport’s videos on YouTube of he and Nadia, they are heart warming and will make you want to fight harder to see that this daughter and dad, are reunited.
