Ofir was abducted by her non-custodial mother, Oshrat Ben-Haim.  Ben-Haim and Ofir travelled to Israel for the holiday of Passover, and never returned home.  Ben-Haim faxed messages to Ofir`s father, Sharon Ben-Heim, stating that she would never return.  A felony warrant for kidnapping was issued for Ben-Haim on December 21, 2011.  New Jersey courts have issued an order for her return.  Aside from a few Skype conversations, Sharon has been completely cut off from his daughter.  He has missed out on all of her birthdays and milestones, such as seeing his little girl walk or talk for the first time.

Haim will issue a ne exeat warrant against him, subjecting him to financial extortion.  The Israeli courts have denied his requests and informed him that if he did not show up, the ruling would be against him, which is in direct conflict of the determinations made through Hague Convention applications.

Sharon saw no other option, and travelled to Israel to fight for his daughter.  Before he even landed in Israel, 2 ne exeat warrants were issued for Sharon, forcing him to remain in Israel for 4 months, during which time he was not able to work, and his expenses quickly added up.  He was forced to return to the United States after 4 months financially destroyed, even after borrowing a great deal of money from his family and friends.  Despite the financial issues he faces, he continues to fight with everything he has to have justice done for his daughter and himself.

In Israeli family court proceedings, the judge ruled that Ben-Haim was unreliable and continuously changed her story.  He ordered Ofir`s return to the United States withing 14 days, providing that Sharon put down a $10,000.00 deposit and rent an apartment for Ben-Haim for 6 months.  Now I will admit, I am quite confused as to this deposit and rental request, but I will keep digging and post any information I can find to clarify this matter.  To date Sharon still has not been allowed contact with his daughter.

  1. The deposit was because the mother had to come with the child due to her very young age and the father was responsible to set that up. Until the child is perhaps 6 there is no chance of her leaving Israel without her mother and maybe not even then since she will have lived in Israel for most of her life. I know because 1.I live in Israel. 2. I came to Israel as apart of a custody arrangement that later fail apart and turned nasty. Not saying what the mother did was right. Just saying.

  2. Actually this child,resident of Migdal Haemek,will not be returned to the United States, unless her father feels brave enough to attempt to take her back forcefully. You understand, the way Israeli courts see the situation,the father is in full agreement with the child’s permanent residence in Israel,due to a drafted albeit unsigned divorce contract in which the father offered to permit the child to remain in Israel and the only dispute is over access. After all,the child is born of two Israeli parents even if born on American soil and Jewish by having a Jewish mother, so the best interests for the child is in the Jewish homeland and the father should come back to his original nation in order to be with his child. This is admittedly not fair to the father who might not be able to return to Israel permanently for economic reasons,but the courts will not separate a child from the Jewish mother to send to a secular nation,therefore the Hague Petition was ultimately denied along with further appeals.
