Victoria was initially abducted by her non-custodial mother, Maria Carrascosa. Maria was prohibited from taking Victoria out of the country, however violated the terms of her divorce from Victoria’s father, Peter W. Innes, and took the little girl to Spain, where Maria is a citizen. At first Peter offered to compromise with Maria, allowing Victoria to have her primary residence in Spain and visitation with Peter in New Jersey. Maria refused this offer and accused Peter of abusing her and Victoria. She was then charged with custodial interference and kidnapping after Victoria’s abduction. Maria was later located and arrested and is currently imprisoned in the Bergen County Jail, Victoria was not with her at the time of her arrest. In November of 2009, Maria was convicted of 8 counts of criminal interference with custody and one count of contempt of court. The judge sentenced her to 14 years in prison, however stated that if Maria returns Victoria to the United States, she will not have to serve any prison time, which Maria refuses to do.
Victoria is still believed to be in Valencia Spain, living with her maternal grandparents, Jose and Juana Maria Carrascosa. Her father has petitioned for her return to the United States by the Spanish Government, but they have not intervened, in fact they have gone so far as to order Victoria to remain in Spain until her eighteenth birthday. She has not seen either of her parents since May of 2005.
